Digital Millennium Copyright Act (DMCA) Policy for TheElevateHomeBuyers.com

1. Introduction

TheElevateHomeBuyers.com ("Website"), operated by Elevate Realty ("Company," "we," "our," or "us"), respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we have adopted this DMCA Policy for reporting alleged copyright infringements that occur on our Website.

2. Reporting Copyright Infringements

If you believe that any content on our Website infringes your copyright, you may submit a DMCA takedown notice
to our Designated Copyright Agent as described below. The notice must include the following:

1. Identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works are covered by a single notification, a representative list of such works.

Upon receipt of a valid DMCA takedown notice, we will investigate and, if necessary, remove or disable access
to the allegedly infringing material.

3. Counter-Notification Procedure

If you believe that your material was removed or access was disabled in error, you may submit a counter-notification to our Designated Copyright Agent. The counter-notice must include the following:

1. Identification of the removed material and its prior location before removal.

2. Your contact information, including your name, mailing address, telephone number, and email address.

3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

4. A statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or Chesterfield, Missouri, if outside the U.S.) and that you will accept service of process from the party who submitted the original DMCA notice.

5. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we may restore the removed content unless the original complainant files a lawsuit within 10 business days.

4. Repeat Infringers

It is our policy to terminate access to users who are found to be repeat infringers of copyrighted content. We reserve the right to disable or delete user accounts at our sole discretion.

5. False Claims

Submitting a false DMCA takedown notice or counter-notice may result in legal liability for damages, including
court costs and attorney’s fees under 17 U.S.C. § 512(f). We strongly recommend consulting a legal professional before filing a notice.

6. Modifications to this Policy

We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting.
